1. Introduction and acceptance
These Terms and Conditions govern the submission, publication, management and use of business listings on the SowetoEkasi.com Business Directory (the “Directory”).
By submitting a listing and ticking the required acceptance checkbox, the business owner or authorised representative confirms that they have read and agree to these Terms and Conditions. Acceptance should be recorded electronically with the date/time and the version of the terms accepted.
2. Listing packages
Free Kasi Starter — intended for small, informal and startup businesses. It may include a basic business name and contact listing, one short business description, one category and limited profile functionality. Paid features such as priority placement, expanded galleries and promotional features are not included unless expressly stated.
Growth Listing — R149 per month. Subject to the features displayed at checkout or on the package page, it may include a verified business badge where eligibility criteria are met, a website or WhatsApp catalogue link, a logo and up to 10 images, up to five searchable categories/tags, review-response access and direct lead messaging where supported.
Premium Listing — R299 per month. Subject to the features displayed at checkout or on the package page, it may include priority placement in relevant search categories, consideration for a homepage interview or blog feature, a gallery of up to 20 images, expanded category tagging and video/social-media link embedding where supported.
Package benefits are subject to availability and the functionality of the website. A feature described as “may include” is not guaranteed unless expressly confirmed as included for the selected package. Priority placement does not guarantee a fixed search position, and editorial features remain subject to approval and availability.
3. Business information and accuracy
The listing owner must provide accurate, current and complete information; ensure that descriptions and promotional claims are truthful and lawful; keep information updated; and provide reasonable supporting information if needed to verify a listing.
The listing owner is responsible for the content submitted and must not misrepresent business registration, licences, qualifications, products, services, prices or affiliations.
4. Verification
A directory listing does not, by itself, prove that a business is registered with the CIPC, compliant with SARS requirements, licensed, accredited or endorsed by SowetoEkasi.com.
Any verification badge is subject to stated verification criteria and must not be understood as a guarantee of quality, financial standing, legal compliance or customer satisfaction.
5. Fees, payments and renewals
The Free Kasi Starter package has no listing subscription fee while it remains available as a free offering. Growth Listing is R149 per month and Premium Listing is R299 per month.
Paid subscriptions are payable in advance using the payment methods presented by SowetoEkasi.com, unless agreed otherwise in writing. Activation and continued publication may depend on successful payment, review and any applicable verification.
Any automatic renewal, recurring debit or ongoing payment arrangement must be clearly disclosed and separately agreed to before it is activated. Renewal dates, billing periods, applicable taxes and payment terms must be shown before payment.
Prices and package features may change prospectively. Changes will be communicated where required by law or reasonably appropriate, and existing paid periods will be handled in accordance with the agreement and applicable law.
6. Cancellation and refunds
A listing owner may request cancellation by contacting SowetoEkasi.com using the details in section 17. The cancellation process, effective date and any remaining payment obligations will be communicated to the listing owner.
Refunds, cooling-off rights, subscription cancellations and any applicable notice periods will be handled in accordance with the agreement and applicable South African law, including any applicable consumer-protection requirements. Nothing in these terms removes a right that cannot lawfully be excluded.
Before publication, SowetoEkasi.com should publish a clear cancellation process that matches its actual billing and subscription system. Do not state that all fees are non-refundable unless that position has been reviewed for legal compliance.
7. Prohibited listings and content
Listings must not contain or promote unlawful goods or services, fraud, impersonation, deceptive claims, defamatory or abusive content, unlawful discrimination, spam, phishing, malicious software, fake reviews, or material that infringes another person’s intellectual-property, privacy or other legal rights.
The listing owner must have permission to use submitted business names, logos, photographs, videos, testimonials and other content.
SowetoEkasi.com may reject, restrict, request changes to, suspend or remove content that breaches these terms or creates a reasonable legal, security or platform-integrity concern. Where reasonably practicable, the listing owner may be notified and given an opportunity to correct the issue or respond.
8. Approval, visibility and website availability
Submitting a listing does not guarantee publication. Listings may be reviewed for authenticity, relevance, quality, compliance and suitability before or after publication.
SowetoEkasi.com does not guarantee a particular number of views, enquiries, leads, sales, a specific search position, uninterrupted access or the continuous availability of every feature.
Reasonable efforts will be made to maintain the Directory, subject to maintenance, technical faults, security incidents, third-party services and circumstances beyond reasonable control.
9. Reviews and dealings with customers
Where reviews or customer feedback are supported, listing owners must not submit fake reviews, manipulate ratings or improperly interfere with customer feedback.
Listing owners remain responsible for their dealings with customers, including the quality and legality of goods or services, prices, delivery, warranties, refunds and complaint handling. Unless separately agreed in writing, SowetoEkasi.com is not a party to transactions between listed businesses and their customers.
10. Intellectual property and permission to publish
The listing owner retains ownership of content and intellectual property they own or lawfully control. By submitting content, the listing owner grants SowetoEkasi.com a non-exclusive permission to host, display, reproduce, format and use that content as reasonably necessary to operate, maintain and promote the listing and Directory.
The listing owner confirms that they have the rights and permissions needed to submit the materials. This permission does not transfer ownership. Any materially different promotional use should have an appropriate legal basis or permission.
11. Personal information and privacy
SowetoEkasi.com will handle personal information in accordance with applicable South African data-protection law, including POPIA, and its published Privacy Notice.
Information may be processed as reasonably necessary to receive and manage listings, communicate with listing owners, administer subscriptions and payments, verify information, maintain security, prevent abuse and meet legal obligations.
Business contact information submitted for publication may be displayed publicly as part of a listing. Listing owners must ensure that they have an appropriate basis or permission to submit personal information about employees, representatives or other individuals.
Before publication, link this document to a complete Privacy Notice explaining the operator’s identity and contact details, purposes and lawful basis for processing, recipients/service providers, retention, security, data-subject rights and how to contact the Information Officer where applicable.
12. Third-party links and services
Listings may link to third-party websites, social-media services, WhatsApp catalogues or other external platforms. SowetoEkasi.com does not control those platforms and is not responsible for their content, availability, security or privacy practices.
Users should exercise appropriate care when visiting external websites or transacting with listed businesses.
13. Liability
To the extent permitted by applicable law, SowetoEkasi.com is not responsible for losses caused by inaccurate information supplied by listing owners, disputes between businesses and customers, third-party service failures or interruptions beyond its reasonable control.
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, or removes rights or remedies available under applicable South African law, including consumer-protection legislation.
14. Suspension, removal and termination
SowetoEkasi.com may suspend, restrict or remove a listing where it reasonably considers that the listing breaches these terms or applicable law, contains materially false or misleading information, has outstanding payment obligations under the applicable agreement, presents a fraud or security concern, or where a service or feature is discontinued.
Where reasonably practicable, notice and an opportunity to remedy the issue will be provided. Immediate action may be taken where necessary to address urgent legal, fraud, safety or security risks. Any refund or payment consequences will be dealt with under the applicable agreement and law.
15. Changes to these terms
SowetoEkasi.com may update these terms to reflect changes to the Directory, its operations or legal requirements. The current version and effective date should be displayed on the website, and material changes will be communicated where required by law or reasonably appropriate.
Where fresh consent is legally required, continued use of the Directory alone will not replace that consent.
16. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. The parties will endeavour to resolve disputes through good-faith communication. This does not prevent either party from exercising a legal right or approaching a competent court, regulator or dispute-resolution body.
